Comprehensive Privacy Notice

How we handle your personal data at Axolingua, under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP). The Spanish version is the legally authoritative text; this English version is provided as a courtesy translation.

1. Identity and address of the data controller

In compliance with articles 15 and 16 of Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (“LFPDPPP”), Axolingua (hereinafter, “the Controller”), with address in Mexico City, Mexico, and contact email info@axolingua.com, is responsible for the processing and protection of your personal data.

2. Scope of this Notice

This Privacy Notice applies to personal data collected through:

  • The website www.axolingua.com, its subdomains, and its contact forms.
  • Direct communications by email, phone, or messaging with the Controller.
  • The provision of language tutoring services contracted by the Data Subject.

3. Personal data collected

For the purposes described in this Notice, the Controller collects the following personal data:

3.1 Identification and contact data

  • Full name.
  • Email address.
  • Phone number (optional).
  • Country and city of residence (to schedule sessions across time zones).

3.2 Tax data (only if the Data Subject requests a CFDI invoice)

  • Name or business name as per proof of tax status.
  • Federal Taxpayer Registry (RFC).
  • Tax address.
  • Tax regime and CFDI use.
  • Email address for delivery of tax receipts.

3.3 Pedagogical data arising from service delivery

  • Level of proficiency in the target language and initial diagnostic assessment.
  • Learning objectives, profession, interests, and context declared by the Data Subject.
  • Session records (dates, duration, topics, assigned homework, and instructor observations).
  • Materials produced by the Data Subject during sessions (exercises, texts, recordings when expressly authorized by the Data Subject).

3.4 Browsing data (see Section 8)

  • IP address, browser and device type, pages visited, and browsing time.

4. Purposes of processing

4.1 Primary purposes (necessary for the legal relationship)

  • Handle information requests and initial inquiries submitted through the contact form.
  • Schedule and deliver the free 45-minute consultation and sample class.
  • Design a personalized study plan based on the Data Subject’s level, objectives, and context.
  • Deliver contracted tutoring sessions, monitor progress, and adapt the syllabus.
  • Send operational communications related to the service (scheduling, reminders, session changes, supporting materials).
  • Process payments via SPEI or PayPal and, where applicable, issue CFDI invoices in accordance with applicable tax regulations.
  • Comply with the Controller’s legal, tax, and contractual obligations.

4.2 Secondary purposes (not necessary for the service)

Additionally, the Controller may use your data for the following purposes:

  • Request feedback on service quality.
  • Send information about new programs, workshops, conversation groups, or other Axolingua services.
  • Send educational content, free resources, or newsletters.

Consent for secondary purposes: If the Data Subject does not wish their data to be processed for secondary purposes, they may indicate so by:

  • Checking the corresponding box on the contact form at the time of collection; or
  • Sending an email to info@axolingua.com requesting exclusion.

Refusing consent for secondary purposes will not be grounds to deny the contracted services.

5. Transfers of personal data

The Controller does not sell, rent, or commercialize the Data Subject’s personal data. However, in order to provide services and comply with legal obligations, the Controller transfers certain data to the following third parties:

  • Tax Administration Service (SAT): for compliance with tax obligations, when the Data Subject requests a CFDI invoice.
  • PayPal (PayPal Holdings, Inc.): when the Data Subject chooses this payment method. PayPal operates under its own privacy policy.
  • Banking institutions: for receipt of SPEI payments.
  • Google LLC: through Google Meet (for delivering sessions), Google Drive (for storing the Data Subject’s materials), and, where applicable, web analytics tools (see Section 8).
  • Competent authorities: where there is a duly grounded and motivated request under applicable regulations.

Pursuant to article 37 of the LFPDPPP, these transfers do not require the Data Subject’s consent as they are necessary for maintaining or fulfilling the legal relationship between the Controller and the Data Subject, or for complying with legal obligations.

6. Exercise of ARCO rights

The Data Subject has the right to Access, Rectify, Cancel, or Oppose the processing of their personal data (“ARCO rights”), as well as to revoke the consent granted.

Means to exercise ARCO rights: The Data Subject must send a request to the email address info@axolingua.com including the following information:

  • Full name of the Data Subject and means to receive a response.
  • Document proving their identity (copy of official ID) or, where applicable, legal representation.
  • Clear and precise description of the personal data on which the right is to be exercised.
  • Any other element that facilitates the location of the data.

The Controller will respond to the request within a maximum of twenty (20) business days from the date the complete request is received, in accordance with article 32 of the LFPDPPP. If deemed applicable, the Controller will act on the determination within the following fifteen (15) business days.

7. Revocation of consent

The Data Subject may revoke, at any time, the consent granted for the processing of their personal data, provided that such revocation does not have retroactive effects nor contravene legal provisions requiring the retention of data (e.g. tax obligations related to issued CFDI invoices).

Revocation is requested via the same channel as ARCO rights: email to info@axolingua.com.

8. Use of cookies and tracking technologies

The website www.axolingua.com uses cookies and similar technologies to improve browsing experience, remember language preferences (Spanish/English) and, where applicable, analyze site usage.

Data collected through these technologies:

  • Language preference selected by the user.
  • Timestamp and duration of the visit.
  • Pages visited and path within the site.
  • Approximate IP address and device/browser type.

The Data Subject may disable cookies through their browser settings. Disabling essential cookies may affect site functionality.

9. Retention period

The Controller will retain personal data for the following periods:

  • Contact data of prospects who do not contract services: up to twenty-four (24) months following the last interaction.
  • Data of active students: for the duration of the service relationship and up to twenty-four (24) months following the last session.
  • Tax data and CFDI receipts: for the periods established by applicable tax legislation (minimum five years).
  • Pedagogical materials of the Data Subject: up to twelve (12) months following the conclusion of the service, unless the Data Subject expressly authorizes their retention in the shared vault for pedagogical purposes.

10. Security measures

The Controller implements reasonable administrative, technical, and physical security measures to protect personal data against loss, misuse, unauthorized access, alteration, or disclosure. These measures include, among others:

  • Access to data restricted to authorized personnel of the Controller only.
  • Use of storage services with encryption in transit and at rest (Google Workspace).
  • Authentication through strong passwords and two-step verification on operational accounts.
  • Periodic backups and recovery protocols.

11. Limitation of use and disclosure

The Data Subject may limit the use and disclosure of their personal data by:

  • Written request to info@axolingua.com.
  • Registration in the Public Registry to Avoid Advertising (REPEP) of PROFECO, where applicable.
  • Configuring their browser to block non-essential cookies.

12. Modifications to the Privacy Notice

This Privacy Notice may be modified due to changes in applicable regulations, the Controller’s business model, or data processing practices. Any modification will be notified through:

  • Publication of the updated version at www.axolingua.com/aviso-de-privacidad, indicating the date of last update.
  • Where applicable, direct notice by email when the change substantially affects the purposes of processing.

13. Acceptance of the Notice

By providing your personal data through the contact form, email, or any other means, the Data Subject acknowledges having read and understood this Privacy Notice, and grants consent for the processing of their personal data in accordance with the primary purposes described.

14. Regulatory authority

If the Data Subject considers that their right to personal data protection has been violated, they may turn to the Secretaría Anticorrupción y Buen Gobierno or the authority that at any given time assumes the functions previously held by the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI).
